1. GENERAL
The term "Kilokruciada" on this website will identify the company SC WORSHIPBODY SRL, based in Tărgu Jiu, Gorj county, Strada 4 Octombrie no. 126, as a seller of nutritional plans and other services mentioned on the website. The services and products offered by Kilokruciada are available both to individuals, legal entities and legal institutions, which have the legal capacity to collaborate through contractual methods. Terms, which are referred to in this document in the form of external links form an integrated part of these Terms and Conditions. Terms, although known, that are not part of this document, only if they are introduced by mutually agreed upon contractual methods.
Kilokruciada is the owner of all materials and information available on the website. Exceptions are the names of registered trademarks and or graphics such as logos of other entities present on the website whose terms are applied individually on their own platforms. Regardless of the nature of the "client" or "visitor" status, copying, reproduction, distribution, public communication, retransmission of any material in any form or manner on this website is prohibited.
Kilokruciada reserves the right to suspend any service and/or product offered in the event that a violation of any provision presented herein is detected. Kilokruciada also reserves the right to disclose information to the customer or visitor to satisfy any legal requirements, in accordance with the Privacy Policy.
2. CONTRACTING
Kilokruciada reserves the right to accept or refuse the order or offer request of a customer or potential customer for a period of 5 working days after examining the level of authenticity and or trust presented by the customer and or order.
3. APPLICABILITY
These provisions apply to all Kilokruciada customers, holders of any of the products or services offered on the website, the use of the services and/or products provided taking place only under these Terms, applying to all contractual relations between the customer and Kilokruciada. The law under which these terms and conditions operate is the one valid at the time the collaboration is initiated.
Identifying all possible interpretations of these Terms as well as covering all possible situations that may arise is almost impossible, therefore any situation or term that is not exposed or dealt with directly or indirectly in this document is under the interpretation of Kilokruciada.
4. FINANCIAL
4.1 Prices
Since the services and products offered by Kilokruciada can be combined or specific to the requirements or needs, the prices of the services and/or products are available on request based on a single offer or those displayed on the website are valid. Depending on the service and/or product chosen, the prices may be different from those displayed on the website.
All payments will be made based on the invoice issued by Kilokruciada. The customer agrees to pay the consideration for the services and/or products in advance of the time period in which they are provided. Regardless of the currency used to display the rates, invoices and payments will be processed in RON at the BNR exchange rate from the date of invoicing according to the legislation in force.
4.2 Invoices
Invoices are sent electronically by email as attachments in .PDF, WORD or image format and physically in the case of sold products. Upon request, they can also be sent with the signature on them. If the customer requests the invoices to be sent in physical format, the shipping cost will be borne by the customer.
4.3 Return of costs
It is possible to request a refund for the services paid to Kilokruciada, but their return will be made under the following conditions:
if the request is made within 30 calendar days from the activation of the customer's order, the full amount will be refunded
if the request is made more than 30 calendar days after the activation of the customer's order, only the amount for the remaining whole months paid will be refunded
The return of the requested amount will be processed in no more than 10 working days to the account from which it was paid.
4.4 Rates
Kilokruciada reserves the right to change the rates charged for the services and products presented on the website at any time. If the new rates apply to customers' current services, they will be notified at least 30 calendar days before they take effect.
All rates displayed on the website or obtained on request are expressed in RON.
4.5 Promotions
In the case of offers with free products or services, they can only be used on the Kilokruciada network. In case of transfer of services to other providers/registrations, the amount equivalent to the activation of these services will be withheld from the client. Kilokruciada reserves the right to terminate the validity of a promotional offer at any time.
5. LIABILITY
Customer agrees to indemnify and hold SDX SDesignX harmless from any claims, damages, including but not limited to third-party damages, resulting from the use of SDX SDesignX Customer's damages services.
SDX SDesignX assumes liability if the interruption of the provision of services and/or products was caused intentionally or is the result of negligence on the part of the SDX SDesignX team. The Client declares that it understands and accepts that the total amount of damages claimed by it for any reason from SDX SDesignX, may in no way and under no circumstances exceed the total amount of fees paid by the client to the supplier on the last invoice for the provision of the services for which damages are claimed.
The customer assumes responsibility for any damages caused directly or indirectly, through the incorrect use of the services provided by SDX SDesignX, respectively, the violation of these terms and conditions. This includes but is not limited to legal fees, attorney fees, notary fees and any other expenses.
6. DATA INTEGRITY
Kilokruciada does not assume responsibility for existing security gaps in the client's applications and for any damages caused by their improper exploitation by the client.
The customer will have access to the accounts via a combination of username and password. He is responsible for keeping this data and other sensitive information secure.
The customer will be liable for any abuse made through the authorized or unauthorized use of this data. If it is found that an unauthorized third party knows these data, the customer's obligation is to reset these data, and to communicate to Kilokruciada staff the new access data in the case of maintenance contracts or content support for which Kilokruciada needs to make the necessary changes to the site based on the contractual understanding.
If the client refuses to communicate the access data, Kilokruciada cannot be responsible for any kind of damage or caused by non-functional applications.
In the case of content maintenance or support contracts, Kilokruciada access to the platform is required.
The customer has the right not to communicate the new access data to the Kilokruciada staff, this decision automatically canceling any contractual values between Kilokruciada and the customer except for the recurring payments required in the case of content maintenance or support contracts.
7. SUPPORT
Each Kilokruciada customer, regardless of the contracted service and/or product, will benefit from standard support through the methods and in the time frame shown on the contact page. Response time may vary depending on the complexity of the issue and the level of support requests open at any given time.
8. VALIDITY
This document is valid for an indefinite period.
Kilokruciada reserves the right to make changes to this document, which is why users are asked to return to this page and consult it periodically.
